This book provides insights into the complex labour and social security framework of EU employment and its enforcement. Starting from an analysis of the various EU instruments and case law, it outlines the complicated legal framework, the practical problems involved, and ways to overcome them. In turn, the book puts the evolution of the framework into perspective, reviews the numerous modifications made over the years, and describes interpretation-related difficulties. Since the formation of the European Community 65 years ago, migration and the European labour market have evolved considerably through special patterns of (temporary) mobility such as postings, simultaneous work in several Member States and high mobility, thus leading to major questions about the applicable legal framework. The interplay between the free movement of persons and services has produced a complex system of rules. Which law applies when a person crosses a border: that of the host State (and to what extent should this State take into account the legal rules from the home State?) or that of the home State? Does the person crossing the border have any choice in the matter?
The book subsequently analyses the penetration of EU (market) law into national systems of labour and social security law. The divergent solutions and views within labour and social security law are considered and discussed from a critical point of view.
As the positive elements of the European story are at risk of being overshadowed by the negative consequences of the European construction - social dumping being the prime example - special attention is paid to the cooperation between inspection services and other stakeholders in order to guarantee efficient enforcement. The latter is more than just sanctioning, but also includes prevention and monitoring issues.
The unique strength of this book is that it brings together all legal-technical aspects of cross-border employment and its enforcement in both labour law and social security law in a single volume. Readers will find a wealth of detailed and specialised information, helping them to understand the topic in depth. Accordingly, the book will be of interest to academics, practitioners, enforcement bodies, judiciary policymakers, advanced law students, and researchers seeking to understand the law in context.
About the Author: Yves Jorens is senior full professor of (European) social law and social criminal law at Ghent University, Belgium. He has an extensive track record in managing large-scale European projects dealing with European social security and labour issues of migrant persons and issues related to social dumping and social fraud. His main domains of research are: the coordination of social security for migrant workers, posting, cross-border employment, social dumping, combatting social fraud and social dumping and the employment situation in the aviation sector. Professor Jorens is currently also director of IRIS│international research institute on social fraud, a knowledge centre that gathers relevant information of regional, national and international interest regarding social fraud in the broadest sense of the word. IRIS constitutes a unique corporation platform between the academic world on the one hand and the different actors involved in the fight against social fraud on the other. He is co-founder and director of LIISA (Lab for International & Interdisciplinary Social Affairs) Ghent University and Honorary Professor School of Sociology and Social Policy, University of Nottingham.

UK Delivery
Orders for delivery in the UK are normally despatched by Royal Mail, using the RM 48 Tracked Service with most orders delivered to you within a few days of placing your order with us. For larger parcels, Courier and Signed For delivery services may be used. Signed Books are shipped in our specially made book mailing cartons, with the books themselves wrapped in paper to protect them. Sometimes we may ship your order in several parts, particularly if you have 'Pre-Order' titles in your order or titles which are held in stock with our publishing partners.
The Really Important Bit: Because we use tracked, courier and signed for delivery services, please use an address at which your parcel can be received during the normal working day, for example, you may want to have your order delivered to your work address if you're not at home during the day.

Another Really Important Bit: There are a number of Postcodes in the UK for which we will need to charge a shipping supplement, this will be calculated once we know the size and weight of the shipment. Where possible, we will ship book orders (under 2kg) by Royal Mail to all UK postcodes. Large multiple book orders and books over 2kg are often shipped via APC Overnight or similar, regardless of Postcode.

From 1st July 2021, VAT will be applicable to those EU countries where VAT is applied to books - this additional charge will be collected by Fed Ex (or the Royal Mail) at the time of delivery.

All overseas orders are shipped using a 'signed for' courier service - please provide an address at which your parcel can be signed for on receipt. In some cases, particularly large and heavy books, or books being shipped to remote areas, may incur an additional shipping charge - if this is the case with your order, we'll notify you as quickly as possible of these charges and to arrange the additional payment. You can of course cancel your order with an immediate refund should you not wish to accept these additional costs. Shipments to overseas territories may incur additional Duty & Tax costs which could be requested by Fed Ex at the time of delivery. Come down the travelators, exit Sainsbury's, turn right and follow the pedestrianised walkway to Crown Walk and turn right - and Coles will be right in front of you. You don't need to shop in Sainsbury's to get the free parking!
